Totem (“Company”, “we”, or “us”) is committed to protecting your privacy. This Privacy Policy explains the collection, use, storage, disclosure and sharing of your information when you visit, use, or engage in exchanges or transactions on websites, including,,, and/or (the “Sites”) and mobile applications, metaverses, communities and other technologies and publications operated by us, including (collectively the “Services”).​​ Capitalized terms that are not defined in this Privacy Policy have the meaning given to them in the Terms of Service.

This policy also explains your choices surrounding how we use information about you, which include how you can object to certain uses of information about you and how you can access and update certain information about you.  If you do not agree with this policy, do not access or use our applications, Services or Sites (collectively, “Services”) or interact with any other aspect of our business.  


By submitting Personal Information and Anonymous Information (described below, collectively “Information”), and accessing and/or using our Sites and Services, you agree to the terms of the Agreement governing the Terms of Use, our Cookies Policy, and this  Privacy Policy and you expressly consent to the collection, use, storage, disclosure, and sharing of your Information in accordance with this Privacy Policy.


As a condition precedent to your use of Sites and Services, you expressly agree as follows:

•  Your information will be shared with third parties only for the purpose of providing Services to you.

•  Your information may be transmitted across national boundaries including to and from and other countries.

•  You are aware of your right to object to the contemplated processing of information and will proceed in accordance with this Policy in order to object.

•  You are aware of the collection and further processing of various information about you in order to provide the services and opportunities contemplated hereby.

•  If you are a European Union resident, you are aware of your ‘right to be forgotten’ under European Union law and to thereby cause the erasure of certain personal data pertaining to you.

•  You are aware of your right to withdraw this consent at any time by deleting your account.  You understand and agree that deleting your account will not remove your data from third-party sites and where your data was posted publicly by third parties. 

•  You are aware of your right to access, modify and delete data pursuant to notice in accordance with the “Contacting Us” section below.

•  We will place ‘cookies’ on your computer or mobile device pursuant to our Cookie Policy.

•  With your consent, you also agree that the geo-location data transmitted by your mobile phone or other device equipped with Global Positioning System technology or equivalent may be used by us to send to You targeted advertising or other communications.


This policy also explains your choices surrounding how we use information about you, which include how you can object to certain uses of information about you and how you can access and update certain information about you.  If you do not agree with this policy, do not access or use our Applications, Services or Sites (collectively, “Services”) or interact with any other aspect of our business.  

By submitting Personal Information (described below) and accessing and/or using our Services, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use, storage and disclosure of your Information in accordance with this Privacy Policy.


We collect two categories of data and information: (1) Anonymous Data, and (2) Personal Information, as each is described below.

  1. Anonymous Information

When you visit the Sites, we automatically collect certain information about your device (e.g., computer, tablet, mobile phone), including information about your MAC address, web browser, IP address, time zone, screen resolution, OS type and version, non-personal demographic information, including the approximate geographic location, your activity on the Sites and Services including the date and time of your visit, the pages you visit and the length of time you spend on those pages, referring/exit pages, pages of our Site that you visit, the time spent on those pages, the information you browse and search for on our Sites. We may also use clear GIFs or web beacons to track usage patterns of users on the Site or Services. Additionally, we may use clear GIFs in HTML-based emails sent to our users to track which emails are opened by recipients.  and some of the cookies that are installed on your device, as well as other information that does not reveal your specific identity. Additionally, as you browse our Sites and use our Services, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Sites, and information about how you interact with the Sites. and Services . We refer to this automatically-collected information as “Anonymous Information”.

We collect Anonymous Information using the following technologies: 

  • “Cookies” utilize data files that are placed on your device or computer and often include an anonymous unique identifier that allows us to log you in automatically and enhance navigation of the site. For more information about cookies, and how to disable cookies, visit 
  • “Log files” track actions occurring on the Sites, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps. 
  • “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you find, browse, and use the Sites and Services so that we can improve your experience and our Sites and Services.

We keep track of certain information about you when you visit our Sites and interact with any of our Services. This information includes the features you use; the links you click on; frequently used search terms; and how you interact with others on the Services. We also collect information about the people you interact with and how you interact with them, like who you communicate with most frequently.

In addition to the tracking technologies including those described above, other companies may set their own cookies or similar tools when you visit our Sites and use our Services. This includes third-party analytics services, credit bureaus, public databases, blockchain data, advertising networks, marketing partners and resellers (“Third-Party Providers”) that we engage to help analyze how users use our Sites and Services and to provide us information that we may utilize in connection with your Information. The information generated by the Cookies or other technologies about your use of our Service (the “Analytics Information”) is transmitted to the Analytics Services. The Analytics Services use Analytics Information to compile reports on user activity, which we may receive on an individual or aggregate basis. We use the information we get from Analytics Services to improve our Service. The Analytics Services may also transfer information to third parties where required to do so by law, or where such third parties process Analytics Information on their behalf. Each Analytics Services’ ability to use and share Analytics Information is restricted by such Analytics Services’ terms of use and privacy policy. By using our Services, you consent to the processing of data about you by Analytics Services in the manner and for the purposes set out above.

  1. Personal Information

We collect information about you when you register for an account, create or modify your profile, set preferences, sign-up for, interact with, or make purchases through the Services, as well as when you engage in chat or forums, post or share photographs, NFTs, videos, audio, text, links, and other content in all mediums (“Content”). For example, you provide your contact information and, in some cases, billing information, when you register for the Services. You also have the option of adding a display name, profile photo, and other details to your profile information to be displayed in our Services.  We keep track of your preferences when you select settings within the Services. Personal Information we collect, includes the information and contact you provide, which may include your name; birthdate; place of birth; digital wallet address; country of citizenship and residency; blockchain address; mailing address; billing address; email address; telephone number(s); credit card information; government issued identification information and proof of identity; tax identification number; occupation; gender; age; relationship status, preferences and goals; your interests; your image and your likeness; activities; calendar; contacts;; photos; videos; links to websites; blogs; posts; social media profiles; companies with whom you do business and interact, and such other information which you may share with us (“Personal Information”). 

Your Personal Information is required for you to access and use our Sites and Services (“Applications”) and do such things as (i) post content and join community forums, (ii) purchase and receive products, goods and Services using our Applications, (iii) mint NFTs and other digital assets, (iv) receive payments and engage in exchange transactions; and/or (v) enter into drops, contests, sweepstakes or other activities that provide you with an opportunity to win prizes, receive discounts, recognition and/or value. Your Personal Information will be accessible and viewable by us and whenever such Personal Information is shared publicly or to non-confidential third-parties by you. Through, and as allowed on, our Applications, and pursuant to our Terms and Conditions of Use, you may enter, transmit, upload, publish and communicate Personal Information.  

You can delete or terminate your account at any time pursuant to our Terms and Conditions of Use.  Once your account is deleted, you will not be able to recover your Personal Information.  


We use both Personal Information and Anonymous Information (your “Information”) to provide you access to, and use of, our Sites and Services, and to authenticate you when you log in to our Applications, to monitor and facilitate transactions for you, and operate, maintain, and improve the Services. We are consistently seeking ways to make our Services smarter, faster, more secure, more integrated, and more useful. We use information and collective learnings (including feedback) about how people use our Services to troubleshoot our Services, to identify trends, usage, activity patterns, and areas for integration to improve our Services and to develop new products, features and technologies that benefit our users and the public.  

We use your Information to send you communications via email, text, pop-ups, or other mediums, including notices of new updates, drops, features and other promotional communications that may be of interest to you (“Communications”). We also provide tailored Communications based on your activity and interactions with our Services and other users.  We use your Information to verify your accounts and activity, to detect, prevent, and respond to potential or actual security incidents and to monitor and protect against other malicious, deceptive, fraudulent or illegal activity, including violations of Terms and Conditions of Use and Privacy Policy. We also use your Information to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Services, including generating analytics about how our customers browse and interact with our Services, and to assess the success of our Services and the way we market, advertise and promote our Services.  Additionally, we may create Anonymous Information records from Personal Information. We use this Anonymous Information to analyze request and usage patterns so that we may improve our Services and enhance navigation and dynamic delivery of content. We reserve the right to use Anonymous Information for any purpose and to disclose Anonymous Information to third parties without restriction.

Specifically we use your Information to do the following:

  1. Facilitate the creation of and securing your account;
  2. Identify you as a user in our system;
  3. Improve the administration of our Services and quality of experience when you interact with our Service, including, but not limited to, by analyzing how you and other users find and interact with the Service;
  4. Provide you with our Services, including, but not limited to, helping you view, explore, and create NFTs using our tools and connect directly with others to purchase, sell, or transfer NFTs on public blockchains;
  5. Provide customer support, resolve issues, and respond to your requests and inquiries;
  6. Investigate and address conduct that may violate our Terms of Service;
  7. Detect, prevent, and address fraud, violations of our terms or policies, and/or other harmful or unlawful activity;
  8. Display your username next to the NFTs currently or previously accessible in your third-party wallet, and next to NFTs on which you have interacted;
  9. Send you a welcome email to verify ownership of the email address provided when your account was created;
  10. Send you administrative notifications, such as security, support, and maintenance advisories;
  11. Send you notifications related to actions on the Service, including notifications of offers on your NFTs;
  12. Send you newsletters, promotional materials, and other notices related to our Services or third parties' goods and services;
  13. Engage in marketing activities, including providing you with targeted advertisements or marketing communications we believe may be of interest to you; 
  14. Comply with applicable laws, cooperate with investigations by law enforcement or other authorities of suspected violations of law, and/or to pursue or defend against legal threats and/or claims;
  15. Engage in any other activities for which you provide your consent; and
  16. Act in any other way we may describe when you provide Personal Information.
  17. As we believe to be necessary or appropriate: (a) in any manner permitted under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations, business and systems; (f) to protect our rights, privacy, safety or property, and/or that of other Users, including you; and (g) to allow us to pursue available remedies or limit the damages that we may sustain; and
  18. To send you important information regarding the Services or Site, changes to our terms, conditions, and policies, and/or other administrative information. Because this information may be important, you may not opt-out of receiving such communications and continue to use the Site and/or Services.

Our default method of communication with you is by email. This choice may be selected on your accounts page. You can also opt out of certain promotional and newsletters communications we provide by clicking on the unsubscribe link.  If you decide at any time that you no longer wish to accept Cookies from our Services, then you can instruct your browser, by changing its settings, to stop accepting Cookies or to prompt you before accepting a Cookie on your first visit to our Sites.  Consult your browser’s technical information. If you do not accept Cookies, however, you may not be able to use all portions of the Service or all functionality of the Service.

Because Anonymous Information does not identify you, we may use and share with third parties non-personal Anonymous Information for any purpose, including our own internal business purposes. If non-personal information is combined with any of your personal information, then such combined information will be treated by us as personal information for so long as such information is combined. We may use certain third-party services such as Google Analytics to help understand the use of the Services. Google Analytics collects the information sent by your browser as part of a web page request, including cookies and the approximate geographic location of your IP address. Google Analytics receives this information and their use of it is governed by their Privacy Policy. We share and disclose your Information for the purposes described above and as follows:

  1. Third Party Service Providers. We may share your Personal Information with third party service providers, such as website hosting, data analysis, payment and credit card processing, infrastructure provision, IT services, customer service, e-mail delivery services, and other similar services to provide services to us, including, but not limited to: providing technical infrastructure services; conducting quality assurance testing; analyzing how our Service are used to: provide technical infrastructure services; conduct quality assurance testing; analyze how our Service is used; prevent, detect, and respond to unauthorized activities; provide technical and customer support; and/or to provide other support to us and to the Services we provide.   2. Affiliates. We may share some or all of your Personal Information and Anonymous Information with any subsidiaries, joint ventures, or other companies under our common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy.
  3. Corporate Restructuring. We may share some or all of your Personal Information in connection with or during negotiation of any merger, financing, acquisition, or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, Personal Information may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.
  4. Legal Rights.  Regardless of any choices you make regarding your Personal Information and Anonymous Information we may disclose such information if we believe in good faith that such disclosure is necessary: (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas, warrants, or other legal process served on the Company; (c) to protect or defend the rights or property of the Company or the users of our Sites and Services; (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Use Agreement; (e) to protect our operations, business and systems; (f) to protect our rights, privacy, safety or property, and/or that of other Users, including you; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

  5. Other Disclosures. We may also disclose your Personal Information : to fulfill the purpose for which you provide it; for any other purpose disclosed by us when you provide it; or with your consent.

Our Services may contain links to websites, mobile applications, platforms, marketplaces, digital wallets, blockchain and crypto services, and other applications provided by Third Parties (“Third Party Sites”). When you click on a link to any other Third Party Sites or or location, you will leave our Services and go to other Third Party Sites, and another entity may collect Personal Information or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these Third Party Sites and/or their policies, terms and conditions of use, products, services, and/or their content, even if such Third Party Sites are required to access our Services. Please be aware that the terms of this Privacy Policy do not apply to these Third Party Sites, or to any collection of your Personal Information after you click on links to such Third Party Sites. We encourage you to read the privacy policies of every Third Party Site you visit. The links to Third Party Sites are for your convenience and do not signify our endorsement of such Third Party Sites or their and/or their policies, terms and conditions of use, products, services, and/or their content. You further agree to release, hold harmless, defend and indemnify us of any claims, damages, liabilities, actions, proceedings, judgments, awards and other liabilities which may result from your use or interaction with Third Party Sites.

  1. Data Retention. We may retain your Personal Information as long as you continue to use the Services, have an account with us, or for as long as is necessary for legal reasons or to otherwise fulfill the purposes and requirements outlined in this Privacy Policy. You can ask to close your account by contacting us as described above, and we will delete your Personal Information on request. We may, however, retain Personal Information for an additional period as is permitted or required under applicable laws, for legal, tax, or regulatory reasons, or for legitimate and lawful business purposes.
  2. Data Protection.  We care about the security of your information and use physical, administrative, and technological safeguards to preserve the integrity and security of all information collected through our websites. However, no security system is impenetrable and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, or failure of hardware or software, we will take steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.​​ You are responsible for the security of your digital wallet, and we urge you to take steps to ensure it is and remains secure.   3. Third-Party Storage and Delivery Networks.  We store the data with our third-party service provider, including Amazon AWS and IPFS. When a third-party service provider is a controller, they may keep data as well, either for a shorter or longer period. Security provisions include:
  1. Access to our database and user accounts by third-party service providers is protected with access control.
  2. Access to the database is limited, not all staff in our organization have full access. 
  3. Data sent from our Services is encrypted in transit where technically possible. We do not actively monitor the security of our databases and need to rely on our processors to notify us of any data breaches.
  1. Users With Whom You Share Your Information. We cannot control the actions of other Users with whom you share your personal information, including information contained in any Content you make available through the Services or Site. We do not control how other Users will use or share any information provided by you.
  2. Targeted Advertisements. We may allow third-party ad servers or ad networks to serve advertisements on the Services and Site. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements, and links that appear on the Services and Site. They may also use technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize the advertising content. While we do not provide any personal information to any third-party ad servers or ad networks without your consent, if an advertiser asks us to show an advertisement to a certain type of audience and you respond to that advertisement, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach. We utilize what we believe to be commercially reasonable physical, administrative, and technical safeguards to preserve the integrity and security of your Personal Information. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. Therefore, we cannot ensure or warrant the security of any information you transmit or provide to us or guarantee that your information on the Sites or the Services may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, administrative, and/or technical safeguards. Additionally, we will not be responsible or liable to you for third-party circumvention of our security measures. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us at

We will not be able to remove your Personal Information from the our database unless you terminate your account.  We also will not be able to remove your Personal Information from any other Users with whom you have shared such information or from third parties to whom you have previously authorized us to share such information (i.e., to which we have already provided your Personal Information as of the date that we implement your opt-out request). Please also note that if you opt-out of receiving marketing-related messages from us, we may still send you important administrative messages, and you cannot opt-out from receiving administrative messages.
  5. Accessing, Changing, or Deleting Your Personal Information. You can update and change your account information and email preferences at any time by logging into your account and editing your Settings. In your Settings, you also have the option to Disable your account, which is equivalent to a “soft delete” where your information is still in our database, but not visible to anyone using the Service. If you would like to review, correct, update, suppress, delete, or otherwise limit our use of your personal information that has been previously provided to us, you may contact us in accordance with the “Contacting Us” section below. In your request, please make clear what information you would like to have changed, whether you would like to have your personal information removed from our database or otherwise let us know what limitations you would like to put on our use of your personal information. We will try to comply with your request as soon as reasonably practicable.
  6. Retention Period. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.
  7. Storage of Personal Information. We may store and back up personal information within databases located within and outside of the European Union and the United States.   9. Do Not Track. Some Internet browsers like Internet Explorer, Firefox, and Safari include the ability to transmit "Do Not Track" or "DNT" signals. Since uniform standards for "DNT" signals have not been adopted, we do not currently process or respond to "DNT" signals. Please note that we do not alter our Services data collection and use practices if your browser sends a Do Not Track signal.

General Data Protection Regulations (“GDPR”).  If you are a user in the European Economic Area or United Kingdom, you have certain rights under the respective European and UK General Data Protection Regulations (“GDPR”). These include the right to (i) request access and obtain a copy of your Personal Information; (ii) request rectification or erasure; (iii) object to or restrict the processing of your Personal Information; and (iv) request portability of your Personal Information. Additionally, if we have collected and processed your Personal Information with your consent, you have the right to withdraw your consent at any time by contacting us at: Additionally, if you are an individual in the European Economic Area (EEA), we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Sites), or otherwise to pursue our legitimate business interests listed above under applicable EU laws. Additionally, please note that your information will be transferred outside of Europe, including to the British Virgin Islands, Canada, and the United States.
  2. California Privacy Rights. If you are a California resident, there are some additional rights that may be available to you under the California Consumer Protection Act (“CCPA”). Pursuant to the CCPA, you may ask businesses to disclose what personal information they have about you and what they do with that information, to delete your personal information and not to sell your personal information. You also have the right to be notified, before or at the point businesses collect your personal information, of the types of personal information they are collecting and what they may do with that information.  This Privacy Policy provides you with the information required by the CCPA.  Generally, businesses cannot discriminate against you for exercising your rights under the CCPA. Businesses cannot make you waive these rights, and any contract provision that says you waive these rights is unenforceable. While in no manner will we discriminate against you as a California resident seeking to enforce your rights under CCPA, certain Information is required to access and use our Services, without which you will not be allowed to, or unable to, use our Services. We encourage you to manage your Information, and to make use of the privacy controls we have included in our Services. In order to protect your Information from unauthorized access or deletion, we may require you to provide additional information for verification. If we cannot verify your identity, we will not provide or delete your Information.

Notwithstanding the above, we cannot edit or delete any information that is stored on a blockchain, for example the Ethereum blockchain, as we do not have custody or control over any blockchains. The information stored on the blockchain may include purchases, sales, and transfers related to your blockchain address and NFTs, cryptocurrencies, or other assets held at that address.

If you no longer wish to use our Sites and Services, you do so by going to your account settings and clicking on “Delete Account” and following the process.  If you have trouble deactivating your account, you can email us at with your request to deactivate your account, however, responding to your email request will take additional time and you release and hold us harmless for any delays in deactivating your account.  We will use reasonable commercial efforts to fulfill your email request.  Please be aware that deactivating your account does not delete your Information. Your Information remains visible to other Service users and Third Party Sites based on your past participation within the Services. Also, Anonymous Information will not be deleted. We have the ability to delete some Personal Information.  We have the ability to delete some information on the Services we control and allow you the ability to stop public dissemination on the Services we control, however, it is your responsibility to delete your Information or request that your Information be hidden on the Services we control, to the extent allowable, by following the instructions on our FAQs.  Please note, however, that we may need to retain certain information for record keeping purposes, to complete transactions or to comply with our legal obligations.  


If you choose to use the Sites and Services, your access and use, and any dispute over privacy, is subject to this Privacy Policy and our Terms of Use Agreement, including, but not limited to, limitations on damages, resolution of disputes, and applicable law.


‍‍The Services and Site are not directed to individuals under the age of eighteen (18), and we request that these individuals under this age do not use our Services or provide any Personal Information to us. We do not knowingly collect Personal Information from anyone under the age of eighteen (18). If we become aware that we have collected personal information from anyone under the age of eighteen (18), without permission from that child’s parent or legal guardian, we will take steps to remove that information.


Totem may change this Privacy Policy from time to time in its sole discretion with or without notice. Totem will post any privacy policy changes on this page.
